I want to know whether I can legally open some business in USA. A sole proprietorship is the simplest business format in USA. I am currently in F1(OPT) visa and will be H1B visa sometime later. Whether F1(OPT) and H1B visa holder can legally open sole proprietorship in USA?
My attorney told the foreigner without Green Card can open business in USA but can't get paid. The sole proprietorship count all business profit/loss as individual income/loss for tax. (Form 1040 Sch C) I am afraid this is not legal for my current visa status.
Anyone here has opened business in USA without a Green Card legally? If yes, could you please share with us which type of company you opened? (Inc, LLP, or ...?)

My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

Hi My wife's H4b status is valid till 6th sept. Now she has her h1b approved on 3rd july. Her employer states that the approved petition has some clause that she has to leave the country and come back with h1 on nov 1st. Both the employer and myself are not comfortable doing that.
Her employer suggesting for h1b renewal under premium process so that i might get receipt in few weeks and also says that he would reapply for H1 wiht the receipt for the approval.
Please suggest me the best possible way ...

If your wife is using the EAD obtained after you filed I-485, she is no longer on H4. Technically there is no reason for her to still be on H4 but if you want her to maintain H4 she may need to travel out of country and obtain a new H4 visa with your new approved H1.
Also technically she was not out of status since you spplied I-485 before the previous H4 expired.

Could you post the actual percentage of EB legal immigrants. If it is 15% then it is sad. It should be at least 50% in order for the country to have the brightest talent.

Just a thought that as we have seen that the current president is know for taking quick decisions. Is there anyway we can get his attention to our cause. Does White house have a fx no# ? Send him faxes etc. and send to all presidential candidates too like Clinton, Obama to etc.
